3. Description of Services

Thip Legal provides legal services in connection with estate and inheritance matters in Thailand, including:

  • Probate Procedural Assistance — preparation of applications, court coordination, and representation through probate proceedings
  • Beneficiary Notification and Coordination — formal notifications to beneficiaries and management of documentary requirements, including for overseas beneficiaries
  • Long-Term Estate Administration — sustained administration for estates with complex assets, agricultural holdings, or minor beneficiaries

Services are subject to the specific scope and terms set out in a written engagement letter for each matter. We reserve the right to decline instructions where a conflict of interest exists or where the matter falls outside our areas of practice.

4. User Responsibilities

When using this website or engaging our services, you agree to:

  • Provide accurate and complete information when making enquiries or instructing us
  • Notify us promptly of any material changes to information relevant to your matter
  • Use this website only for lawful purposes and in accordance with these terms

6. Payment Terms

Fees for specific services are set out in the engagement letter for each matter. General arrangements are as follows:

  • Fees are quoted in Thai Baht (฿) and are inclusive of applicable disbursements unless stated otherwise
  • A retainer or initial payment may be required before work commences
  • Invoices are payable within 14 days of issue unless otherwise agreed
  • We accept payment by bank transfer; details will be provided in the engagement letter
  • Outstanding fees may attract interest at the rate specified in the engagement letter

Refunds

Where work has not yet commenced, fees paid in advance may be refunded at our discretion, less any administrative costs incurred. Once work has commenced, fees for work already performed are non-refundable. Any refund arrangements will be set out in the engagement letter.

10. Indemnification

You agree to indemnify and hold harmless Thip Legal, its lawyers, and staff from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these terms, your misuse of this website, or your provision of false or misleading information in connection with a legal engagement.

11. Termination

Either party may terminate a legal engagement by giving written notice, subject to the terms of the applicable engagement letter. On termination:

  • You remain liable for fees in respect of work carried out prior to termination
  • We will return your documents and original materials on settlement of outstanding fees
  • Obligations of confidentiality and any provisions that by their nature survive termination will continue to apply

We reserve the right to terminate our engagement where you have provided materially misleading information or where a conflict of interest comes to light after instructions have been accepted.

12. Dispute Resolution

These Terms & Conditions are governed by the laws of Thailand. In the event of a dispute:

  • Informal resolution: Both parties agree to attempt to resolve disputes informally by written notice before commencing formal proceedings
  • Mediation: If informal resolution fails, either party may request mediation through a mutually agreed mediator before proceeding to court
  • Jurisdiction: If mediation does not resolve the matter, disputes shall be subject to the exclusive jurisdiction of the courts of Surat Thani Province, Thailand

13. General Provisions

  • Entire agreement: These terms, together with any engagement letter, constitute the entire agreement between the parties in relation to the subject matter
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force
  • Waiver: Failure to enforce any provision on one occasion does not constitute a waiver of the right to enforce it on another
  • Assignment: You may not assign your rights or obligations under these terms without our prior written consent

14. Changes to These Terms

We may update these Terms & Conditions from time to time. Changes will be published on this page with a revised "Last Updated" date. For ongoing client matters, material changes to these terms will be communicated directly.
