Our Story

Founded in Surat Thani, Rooted in the South

Thip Legal was founded in Surat Thani by a group of legal professionals who had observed, over many years, how often families were left to navigate probate and inheritance matters without adequate guidance. The probate process in Thailand involves precise documentary requirements and court procedures that vary by jurisdiction — and the consequences of errors or missing documents can add months to an already difficult period.

The practice was built specifically around the needs of families in the south of Thailand: those dealing with local estates, agricultural land, fishing business interests, and the particular legal arrangements that apply in a region with its own distinct land tenure and family law context. We have worked with Thai families, with expatriate residents whose estates cross jurisdictions, and with beneficiaries located abroad who require coordinated support.

Our approach has not changed since the practice opened. We listen carefully, explain the relevant process in plain language before any engagement begins, and we are direct about both timelines and the points at which family involvement is required. We do not make the matter move faster than the law or the courts allow. We make sure it moves correctly.

Inheritance Law in Thailand — What Families Need to Know

The Thai Civil and Commercial Code governs how property passes to heirs following a death. Where the deceased left a valid will, the probate court appoints an administrator to carry out its terms. Where no will exists, the court determines distribution according to the statutory order of heirs. Both processes require court involvement, specific documentary filings, and, in most cases, appearances by family representatives at hearings.

The complexity of an estate increases with the number of asset types involved. Real property — particularly agricultural land in the south — requires title deed transfers that must be coordinated with the relevant land office, separately from the probate proceedings. Business interests, bank accounts, and investments each have their own transfer requirements. An estate that includes several of these asset types may involve parallel processes running over an extended period.

Families most often encounter difficulty not in understanding what needs to happen, but in the documentary preparation that each step requires. Documents must be originals or certified copies, translations must be certified by a qualified translator, and signatures must sometimes be notarised before they are accepted by the relevant authority. Our role is to manage this preparation thoroughly so that each stage proceeds without the delays that come from incomplete filings.
